Re: Starcraft: spring on mar-sara
Renaming things isn't enough to avoid a copyright. If your units behave identical to SC (even with minor changes) you've got a derivative work on your hands and copyright doesn't allow those. Blizzard absolutely doesn't appreciate trolling and will slam you down hard.
Re: Starcraft: spring on mar-sara
what are their names? replace the unit names with the lawyers names.Beherith wrote:lawyers blizzard has...
edit:
in your guys opinions, exactly how different from original SC would this game have to be in order to avoid legal mayhem
Re: Starcraft: spring on mar-sara
In my 100% layman opinion, the models would have to be different, the textures and the names for anything cant have any matches.
Re: Starcraft: spring on mar-sara
Blizzard DON'T OWN ORCS! Nobody own. Its very old fiction like classic music so nobody owns it. Blizzard this, Blizzard that - Blizzard can go [censored] if they will come with claims.zwzsg wrote:Masse is already making an orc vs nazi from space Spring mod! Though I would be unhappy if you caused his project to be smashed by Blizzard lawyers before I could even play it.smoke_th wrote:I'm also thinks about orcs.
Edit:
Blizzard don't own this models and textures (they arefan made) and they are different - i'm already saz about china unlicensed car clones so nope.

Re: Starcraft: spring on mar-sara
Names and titles are not copyrightable but if a person is using a character or creation in a way that is clearly attempting to borrow from a copyrighted work and to make use of that work in selling something, then it is a copyright violation.
The use of orc-like creatures called trolls, goblins, etc is not a copyright violation, since such things exist in mythology and you are not necessarily exploiting Warcraft any more than anything else. Being a mythological creature subject to many interpretations, i think "orcs" is free range.
Same thing applies to marines, battleships, etc.
But if you used "lurkers", they'd come a'knocking....

Re: Starcraft: spring on mar-sara
WTF?what models?what textures?weren't they sprites in SC1???
Re: Starcraft: spring on mar-sara
Orcs were invented by Tolkien, they aren't part of any mythology directly. Orco means ogre, ogres are indeed part of a mythology but not their derivative orcs. Elves in their current form are also an invention by Tolkien but dwarfs are mythological.

Let's say you make a unit named lurker that's a submarine which can also burrow and shoot spikes. Who will sue you first, Blizzard or Atari?d-gun wrote:But if you used "lurkers", they'd come a'knocking....

I would advise against releasing any binaries here so as to establish that this thread is merely advertising, not project hosting.
Remember, just because you have a whimsical argument that holds logically that can get us off, doesn't mean Blizzard cant use its money to bend the rules of logic and nullify it using flashy presentations and arguments from clever lawyers that baffle the judge into agreeing with them.
Heck there is already enough in this thread on trolling Blizzard to crush this project in court or at least file a lawsuit should they feel the need. Dont take everyone else here down with you, especially with Blizzard if they decide its too easy to make clones using the spring engine and it must be nuked to prevent future clones

Re: Starcraft: spring on mar-sara
Hm... i think not. Guess blizzard haves not so terrible layers. Damn why you all afraid so much? Also before it will be done a personnaly contact with blizzard techsupport and ask about my project. To be honest there is one plus to EA, they are supporting any stuff like this but merged with their copyrights - Red Alert - Path beyond, and other manually done stuff by fans - there is also adversiting on their site - there is must be a good example for blizzard, if a sudden blizzard will be indignant.AF wrote:I would advise against releasing any binaries here so as to establish that this thread is merely advertising, not project hosting.

You know if they will close my proj - all internet will know about what douche-bags they are - don't afraid - I do not know no one precedent which would blizzard closed the fan projects - and fan projects were.
Edited - well I send this letter to blizzard few minutes ago
I'm beginning to fan a free project for Starcraft universe under free rts engine spring. Frankly I do not even know how to name it, because I do not know how your lawyers will respond to this information. There are two possible titles - one more for copyright are and one with custom name:
1. Starcraft - spring on mar-sara
2. Craft of the stars - Ve-nera conflict.
Here is a link to the initial topic in the forum. (sorry for some rude words, but still...sc 2 lost original atmosphere IMHO of course)
http://springrts.com/phpbb/viewtopic.php?f=14&t=23142
Quite a lot of people are afraid that if I start this project then your lawyers slam it together with all free engine spring.
So I need to know if you will not refuse to grant me permission to create this project. Before denying take a look at one of your competitors - EA - they support the fanatical projects. For example very powerfully made on the original Hacks C & C Renegade: Project Red Alert - A Path Beyond. And loads of others. And of course if I get your official permission to draft in the first place - will not sickly wave of fan projects because of their lack of your projects, and I think you better start to the fans is, in principle, they normally are but I still can not know Your opinion about the fan projects using elements of the original games and their names. I repeat this is non-profit fan project. So please. If he whom I am sending this letter is not competent in this matter let this letter will reach those who are competent in this matter.

Re: Starcraft: spring on mar-sara
quick note. why has there been no legal bombardment by the people who hold the IP for TA and warhammer???......also the fact that this was/will not made for profit and is open source should give him some protection????.....i say just talk 2 a lawyer about this......and i don't think the court can do much to a open source software
i also would note that if this mod get rolling and people get disillusioned with SC2...this can get very big and bring alot of new people 2 spring....
(also u might wana diminish the combat simulation feature for spring to capture the feel of sc....and make maps with the feel and style of bizzard rts maps.....resources :/, gl mate....)
god i would love to see how blizzard's PRs will word them crushing a poor little open source project just to monopolize the situation(basicly force thier fans 2 just play thier game) and guarantee maximum profit.....IP is stupid....
