I know its old news, but still, just shows that it really is wrong to take the internet with an RL approach :

"The Associated Press tells the story of Michael Fiola, a former Massachusetts government employee who was arrested in 2007 after child porn was found on his state-issued laptop computer. He was eventually cleared of all charges after some digging by the defense found that the laptop was infected with malware that was 'programmed to visit as many as 40 child porn sites per minute ÔÇö an inhuman feat. While Fiola and his wife were out to dinner one night, someone logged on to the computer and porn flowed in for an hour and a half. Prosecutors performed another test and confirmed the defense findings. The charge was dropped ÔÇö 11 months after it was filed.' The article also discusses the technical aspects of how it could happen and about similar cases in the United Kingdom in 2003."

yeah we all knew it will happen...

why dont they arrest those 40 child porn site owners instead...? weird

oh wait, in japan its not illegal, more likely a way of life, some people just like younger

That's scary, frankly. That poor guy and his wife probably went through hell, just to defeat that case.

And if the intent of the malware writer was to get people arrested and thrown in jail (as opposed to just being obnoxious while eating child-porn websites' bandwidth) then they'll probably write new versions that are more... "natural" in their behavior.

Dirty pool all around, and don't think that the authorities will learn anything, either. To cops, at least here in the USA, even the suggestion of child porn is a very handy excuse for doing a whole-harddrive search (which, btw, there was a recent Supreme Court ruling about, makes for interesting reading).

To be honest I would want to see more of these cases pop up. Since if not the cops, then the people who are trying to fight against current policies will have some real background to their claims.


Same as illegal torrent downloads, the more "frameware" there is, the sooner it will come to a point that an average person will be able to realise that people are being put into jail for the things they have never done, and massively.


I really never understood the idea of going after the user, and not the provider of the content..

People already get sued and put in jail for things they could never have done in the name of piracy, theres plenty of blogposts about people are websites whove had company media enforcement investigators come search their home then refuse ot give back the stuff they siezed, while official law enforcement refuses to intervene.

Its interesting to see this topic only to last for 9 posts. Its also interesting to see people having a clear "it wont ever happen to me" feeling. I am glad I had received at least some real answers :)

AF, was that line to me? Because warnings from ISPs are not media company people taking computers from homes and the police refusing to help. I did a quick google anyway, didn't see anything. Please provide references.

Oh, I doubt it. Most people don't realize that the majority of cases here no longer make it to trial. Most people don't recognize the racial disproportionality in incarceration as compared to crimes committed, or the systemic disproportionality in punishment to crime content. Or the unconstitutional nature of Megan's Law.
