I've always built depthcharges in these occasions.

This means if you get close enough so that the deptcharge drops on to the top of the sub, the sub takes no damage (complain to spring devs >_>).
This also means that janus-submarine, and many other submerged units, wont take damage if you forcefire on a above-surface portion of the hitsphere with a non-AoE weapon. (If the HLT laser, in the example, goes UNDER the water and hits the SUBMERGED portion of the hitsphere however- full damage!).
