Or their ToS is just for kicks and giggles, but I guess there's only one way to find out - try opening a project and uploading blatant warez, see what happens.

Blatant violation for the sake of violation would surely be taken down quickly, but something as minor as using content from what is now a commercially-worthless game, when said content can be easily obtained from any number of "respectable" sites, is probably just being ruled as "who cares".

I've seen lots of examples on sourceforge of this sort of thing being given the pass. Maybe they'll crack down one day, but they haven't in the last 10 years.
