Good grief, lighten up. Don't make this a moral issue again ! Morally, the original creators don't care what happens to their intellectual property, i think most of them are glad the spirit of their game STILL lives on.
But if you want to talk about a supercompany possibly enforcing their rights on a small community, ok lets talk. Atari may sue, yeah, so what. Does that make them the good guys ? They did not care one bit for the TA community, that lived on and on. It was the community that created new content, not some company.

I personally don't give a shit if it's legal or not and i don't feel bad, not even for a femtosecond, for ripping off a company like Atari. If they would be a small, poor team of devs, that struggles for their dear life, then maybe, but Atari ? LOL.
