Frankly, I think it's a bit dirty for chanserv to be taking the logs, when it downright refuses to leave, even when the founder tells it to.

Whether to log a channel will be able to be set by the founder, and it will possibly also be optional to make the log public through the web interface (it's good for more than just admin stuffs).
The contents of private messages will not be logged, only the fact the private message occurred (and even this will probably expire quickly).

Chanservs logging of channel messages is violating EU privacy laws, aswell as countless privacy laws specific to individual countries.
The main beef being that nobody is notified that chanserv logs channel messages by either the lobby or chanserv, as such they are unaware of the logging which makes it unlawful.
Aegis has the right frame of mind with his features to allow the logging to be turned on and off according to what the channel founder says, but he must make sure that the client can tell if logging is turned on or off and whether it is public or not, but he has not given details so I cant comment on this any further.
Public channel logs in the mean time would allow for several lobby features to be added, assuming they're in a nice easy to parse format.

even outside of legal reasons it's a bit weird and i didn't realise it happened, i thought it was only #main, especially as #main is the only one moderated

Its not that the channels are logged, its that nobody is told they're logged. As such it could be termed as unlawful spying in various countries.

it's part the EULA you accepted when you logged in in tasserver the first time, so when you clicked yes you admitted you were informed and accepted the conditionsAs a user you agree to any information you have entered above being stored in a database. Channels must be explicitly stated and logs of channels must not extend past a certain time period which varies from country to country.
Some countries state that active attempts to make the user aware fo logging must be taken and hiding it in EULA is not enough.
Some countries also demand that when a user asks for any information held about them, they should be given it, so a founder must be able to see the recorded logs for their channel. As far as I know in the UK a minor fee for retrieval charges can be requested.
