I've heard reports that this began a few days before Christmas, so the Christmas rush theory may be moot. I just got an xbox360 for Christmas, so its been frustrating dealing with Live. Sometimes it doesn't connect, and other times when it I does connect its very unstable. Bit annoying having to deal with a service which most others offer for free (eg: Sony PSN, and general PC online content excluding MMOs) being so unreliable from the moment I subscribe. :S

If xbox live is down and nobody cares, is it still a 404?

the server will only throw a 404 if the page is requested and doesn't exist
if noone cares, noone requests the page, no 404

How can you know that for sure?
