Supreme Commander was widely marketed as the 'successor to TA', and Atari didn't bat an eyelid. If you go back to when it was about to be released, every single article would mention Total Annihilation - even though SupCom had no legal ties to TA whatsoever. Firstly, it's a major selling point, because TA was regarded as one of the most innovative games of it's genre, and was voted by Gamespy as the best RTS of all time. Secondly, if a major company can get away with making a link between TA and their game, and directly profiting off that link, we can easily do the same, assuming we use legally safe language (while still making the direct link).
