Common sense...

Post by Das Bruce »

Stolen from another board :P

"A Remarkable Obituary:
Today we mourn the passing of a beloved old friend, Mr. Common Sense. Sense had been with us for many years. No one knows for sure how old he was since his birth records were long ago lost in bureaucratic red tape. He will be remembered as having cultivated such valuable lessons such as knowing when to come in out of the rain, why the early bird gets the worm and that life isn't always fair.

Common Sense lived by simple, sound financial policies (don't
spend more than you earn) and reliable parenting strategies (adults,
not kids, are in charge).

His health began to rapidly deteriorate when well intentioned
but overbearing regulations were set in place. Reports of a
six-year-old boy charged with sexual harassment for kissing a
classmate; teens suspended from school for using mouthwash after
lunch; and a teacher fired for reprimanding an unruly student, only
worsened his condition.

Mr. Sense declined even further when schools were required to
get parental consent to administer aspirin to a student; but could
not inform the parents when a Student became pregnant and wanted to have an abortion.

Finally, Common Sense lost the will to live as the Ten
Commandments became contraband; churches became businesses; and criminals received better treatment than their victims.

Common Sense finally gave up the ghost after a woman failed to
realize that a steaming cup of coffee was hot, she spilled a bit in
her lap, and was awarded a huge financial settlement.

Common Sense was preceded in death by his parents, Truth and
Trust, his wife, Discretion; his daughter, Responsibility; and his
son, Reason.

He is survived by two stepbrothers, My Rights and Ima Whiner.

Not many attended his funeral because so few realized he was
gone.

If you still remember him, pass this on; if not, join the majority
and do nothing."

Just wanted to point out some facts behind that...

From wikipedia
"In February, 1992, Liebeck, a 79-year-old woman from Albuquerque, New Mexico, ordered coffee from the drive-thru of a local McDonald's restaurant, which she then spilled on her lap. The hot coffee burned her, and she subsequently sued McDonald's."

"Liebeck was taken to the hospital, where it was determined that she had suffered third-degree burns over six percent of her skin. She remained in the hospital for eight days while she underwent skin grafting. Two years of treatment followed."

"Liebeck sought to settle with McDonald's for US$20,000 to cover her medical costs, but the company offered only US$800. When McDonald's refused to raise its offer, Liebeck filed suit, accusing McDonald's of "gross negligence" for selling coffee that was "unreasonably dangerous" and "defectively manufactured."

"McDonald's quality control manager also testified that foods hotter than 140 degrees constituted a burn hazard, and that McDonald's coffee would burn the mouth and throat."

"Testimony by witnesses for McDonald's revealed that McDonald's did not intend to reduce the heat of its coffee. However, the National Coffee Association of USA recommends that coffee be brewed at 195-205 degrees Fahrenheit and, if not drunk immediately, should be maintained at a temperature of 180-190 for optimal flavor. [1] Starbucks, for example, serves its coffee at this temperature, and, indeed, has been subjected to similar lawsuits for coffee spills. Most courts have dismissed these cases against Starbucks."

Actually, that woman's coffee was at about 190 degrees fahrenheit. The spilled coffee caused her third degree burns and she needed skin grafting. Most coffee is kept at around 135-140 degrees. So yes, coffee is hot, but should not be so hot that it causes third-degree burns in seconds...

Not only that, but coffee at that temperature makes the styrofoam cups they are stored in less stable, making a spill considerably more likely.

This case annoys me.

Edit: didn't notice that Kixxe already answered this, how I missed it is beyond me...

Except they offered $800 dollars in compensation... and wouldn't yeild. The real lesson is, refuse to settle when you're wrong and it will chew a hole in your ass.
