Hard to say what really happened from just this video, but what I react to is that the com is napped from under the surface. I think that's a bit wrong, a bear (the transport ship) shouldn't see whether a com is hiding under the water.

Also , the commander was moving, but at a slower speed under water. The speed was slow enough for the trans to pick it up it seems.

Imo, as i've said before, just remove the transportation of enemy units.

But how did the transport ship get LOS on the commander? Was he partially over the surface? Beacuse bear doesn't have any sonar.

Maybe disable loading things more than 50% under water, or when commander cannot d-gun?

The commander wasn't completely submerged.

Why do we not have it set up so that destroying/self-destructing a transport just drops the commander with minor fall damage?
