It seems that using buildbar as main place to build units is not ideal. Problem is it appears in the middle of screen (can be fixed by moving it around) and that it shows units in one long line.. You can link to closed-source libraries under the GPL, hence why there are GPL apps that use DirectX etc.

oh, sorry, I misinterpreted you.

If it was regular units, I would say yes. But as it is commanders, I don't know if there is something special with them.

When you loose your commander, you spectate and you're units stay on the battlefield.
If all the players of a team are spectating (no more commander), they loose.
